Australian Consumer Law (ACL) — Consumer Guarantees
Where our services are supplied to a consumer within the meaning of the Australian Consumer Law (ACL), certain guarantees apply which cannot be excluded, restricted or modified by agreement. These include guarantees as to:
- services being provided with due care and skill;
- services being fit for any specified purpose;
- services being supplied within a reasonable time when *** timeframe is agreed.
Our Terms aim to operate consistently with ACL. If you are a consumer and your statutory rights under ACL apply, our liability for failing those guarantees is subject to ACL and any other applicable law.
Terms of Service & Limitation of Liability
Services are provided under our written engagement letters or statements of work. Key points:
- Scope: Deliverables and acceptance criteria are defined in each engagement.
- Intellectual property: Unless otherwise agreed, we retain ownership of pre-existing code and tooling. Client receives licences to final deliverables as agreed.
- Limitation of liability: Subject to applicable law (including ACL), our aggregate liability is limited to the fees paid for the services giving rise to the claim.
- Warranties: We warrant our services are performed with reasonable care and skill. Other warranties are excluded to the fullest extent permitted by law.
Privacy, Data Handling & Cookies
We process personal information to provide services, communicate, and meet legal obligations. Our privacy practices comply with the Privacy Act 1988 (Cth) and relevant Australian privacy principles where applicable.

Notices, Intellectual Property Claims & Dispute Resolution

- a statement of good faith and accuracy;
- signature of the authorised person.
We aim to resolve disputes promptly. If a dispute cannot be resolved by negotiation, parties may agree to mediation before commencing court proceedings in Australia. Applicable law: the laws of New South Wales, Australia, unless otherwise agreed.
